An alien is not permitted to apply for employment authorization for a fiscal year if he or she has applied for such authorization during the preceding five-year period. An alien who is the spouse, partner, parent, or dependent of any other person, who is not a U.S. citizen or an alien lawfully admitted for permanent residence, who is a student, does not have to file I-766, Application for Employment Authorization.
