What documents are needed for an H4 visa EAD?
I may not want to miss even a single document from the list hence pasting a link below which is a step by step guide for obtaining H4 EADhttp://www.immihelp.com/h4-visa-...Eligibility RequirementsYou are eligible if you are the H-4 dependent spouse of an H-1B nonimmigrant if your H-1B nonimmigrant spouse:Is the principal beneficiary of an approved Form I-140, Immigrant Petition for Alien Worker; orHas been granted H-1B status under sections 106(a) and (b) of the AC21. The AC21 permits H-1B nonimmigrants seeking employment-based lawful permanent residence to work and remain in the United States beyond the six-year limit. How to ApplyYou must file Form I-765 and receive an Employment Authorization Document (EAD/Form I-766) from USCIS before you may begin working. While USCIS currently is continuing to accept the older version of Form I-765 with an edition date of 5/27/08 or later, we encourage H-4 applicants to use the newer version with an edition date of 2/13/15 in order to prevent delays or the need for USCIS to issue you a request for evidence.Carefully follow these steps to prevent your application from being rejected and returned to you:Complete Form I-765 using the Instructions for Form I-765. Additionally, if you included the fees for both forms on the same check or money order, USCIS may also reject your Form I-765 for category (c)(26). Note: If you are filing Form I-765 together with Form I-485 at the USCIS location noted for Form I-485, you should specify your work eligibility category as (c)(9) and pay only the Form I-485 filing fee (and not the Form I-765 filing fee) to avoid processing delays.u00a0u00a0 Submit supporting evidence (see chart below). What are the necessary steps to apply for a green card for a F1 student who is currently married with a US citizen?
You will have to file for adjustment of status in the U.S. The basic steps are as follows:Your relative (spouse) will have to file I-130 for your benefit as an immediate relative of a US citizen. Petition for Alien RelativeYou have to file form I-485 to apply for the green card. Application to Register Permanent Residence or Adjust StatusYou should also file, although not required I-765 (application for employment authorization) Application for Employment AuthorizationRead the instructions of each document and send them with all supporting documents and payment to the Chicago lockbox as indicated by USCIS: Direct Filing Addresses for Form I-485, Application to Register Permanent Residence or Adjust StatusSupporting documents will include:picturespassport, visa, i-94 photo copiesbirth certificate (for your and your spouse to prove citizenship or naturalization certificate)marriage certificateany joint assets (bank account, car titles, home deed)other joint documents (car insurance, health insurance, credit card with both names, utilities, joint travel: hotel bills, boarding pass, tickets etc.)pictures of you together, with family etc.Basically you have to prove you are who you say you are, your spouse is a citizen, you guys have a bona fide marriage.Once you file you will get an appointment for fingerprinting. In a few months you will get a appointment with local USCIS officer. You must both present yourself and prany additional documents to prove bona fide marriage.Itu2019s a fairly straight forward process. Good luck.
For some reason my EAD card was not delivered and has been sent back to the USCIS. My 90-day unemployment period is about to end. I have a job offer but I cannot work now. Do I have to leave the country?
First of all, I donu2019t understand why you have to leave the country. If the EAD card was approved that means that USCIS is working on your case and thatu2019s a good reason to not leave the country. The EAD card might have been returned to the USCIS because of the mistake with the address or the delivery person couldnu2019t access your mail box and then sent it back to the sender who is in this case USCIS.Just contact USCIS which your case number or receipt number and explain to them what happened, they will be able to send it back again to you and they will verify the address if this was the reason why your EAD was returned back to them.Regarding your job offer, you can try and explain to them the situation and show them some document which shows that your EAD was approved but just undelivered hopefully they will be able to wait untill you get your EAD card.Good luck.
The STEM OPT Extension got approved but the EAD card never arrived. I have been in contact with the USCIS to resend the card consistently, but it never arrived. Would I be able to apply for the H-1B?
How long has it been since your I-765 application was approved? Sometimes it can take some time for USCIS to make the physical card. From what I remember, when USCIS sends out the EAD, the case status site will be updated to indicate that the card has been mailed out. Did you call USCIS to confirm that the address on file is correct?Regarding the H-1B, you can still apply if you find a job and the US sponsor is willing to sponsor you for the visa.*I am not an attorney.
